Florida state legislators may be called into a special session later this year to discuss an issue at the top of Governor Charlie Crist’s agenda—the state’s personal injury protection law.
Crist wouldn’t commit to a specific date for a legislative session but said he would favorably view “a special session before October 1��?—which is when the current law requiring drivers to purchase personal injury protection (PIP) insurance policies expires.
As it stands, the law requires drivers to carry $10,000 in PIP insurance and, in some instances, restricts an individual’s right to sue when injured in an accident.
Opposing Views
However, State Farm, the state’s largest auto insurer, says the law is outdated and rife with fraud. The company also claims that it encourages medical providers to keep their costs high.
The hospital industry and health insurance companies, on the other hand, favor renewing the law. From where they stand, the law ensures that injured motorists receive a minimum level of health coverage.
Crist agrees, “It’s important for health care. It’s important for me.��?
Perhaps a more appropriate question is not whether the law is good for insurance companies, but whether it’s good for individuals who’ve suffered injury in an accident since it may restrict them from filing legal claims to pursue additional damages.
